By using the ConnectUs app (the "App") developed and operated by ConnectUs UG (the "Company"), you acknowledge and agree to the following terms:

1. Limitation of Liability

To the fullest extent permitted by law, ConnectUs UG shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages, or any other damages of any kind (including, without limitation, loss of profits, data, or goodwill) arising from:

  • Your use or inability to use the App.

  • Any content, materials, or information transmitted or received through the App.

  • Any conduct, whether online or offline, related to the App.

  • Any third-party interactions, products, or services connected to or made available via the App.

This limitation applies regardless of whether the Company has been advised of the possibility of such damages. You assume full responsibility for any risks associated with the use of the App. This limitation of liability does not apply to damages resulting from gross negligence or willful misconduct.

2. Parental Responsibility

If you are a parent or guardian, you acknowledge and agree that you are solely responsible for supervising your child’s use of the App. The Company disclaims all liability for any harm or damages that may result from your child’s access to or use of the App. It is your responsibility to ensure that your child’s use of the App is appropriate and safe. The App is not intended for children under the age of 18.

3. Compliance with Local Laws

You agree to comply with all applicable laws, regulations, and rules in the jurisdiction where you use the App. You understand that any unlawful use of the App or violation of these laws is solely your responsibility. The Company is not responsible for ensuring compliance with local laws or regulations, nor does it assume any responsibility for activities that occur through the App that may violate these laws. By using the App, you agree to comply with all laws and regulations governing its use in your jurisdiction. You may not use the App in any country where it is prohibited by local law or where it would violate international sanctions or export control regulations.

4. Data Collection and Privacy

The Company collects a variety of personal data and other information from users of the App. By using the App, you consent to our collection, storage, and use of your data in accordance with our [Privacy Policy] and [Cookie Policy]. Please review these documents to understand how we collect, use, and protect your personal information. You have the right to withdraw your consent at any time, as outlined in our Privacy Policy.

For users in the European Union, we comply with the requirements of the General Data Protection Regulation (GDPR). For users in California, we comply with the California Consumer Privacy Act (CCPA).

5. Service Availability and Downtime

The Company does not guarantee uninterrupted or error-free access to the App. The App may be temporarily unavailable due to system upgrades, maintenance, or other issues beyond the Company’s control. The Company is not responsible for any interruption, delay, or failure in service, and you agree that the Company shall not be liable for any damages resulting from such downtime. The Company will make reasonable efforts to minimize downtime and keep you informed of any planned maintenance.

6. Force Majeure

The Company shall not be held liable for any failure or delay in the performance of its obligations under this Agreement due to circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, technical failures, network outages, government actions, or other events outside of the Company’s control.

7. Dispute Resolution and Governing Law

Any disputes arising out of or relating to this Agreement shall be governed by the laws of Germany, and you agree to submit to the exclusive jurisdiction of the courts in Berlin, Germany. You agree that any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the competent courts located in Berlin, Germany. However, if you are a resident of the United States, you agree to submit to binding arbitration in accordance with the rules of the American Arbitration Association (AAA) in lieu of litigation, except where prohibited by law.

8. Modification and Termination

The Company reserves the right, at its sole discretion, to modify, suspend, or terminate the App or these Terms at any time, without prior notice. Continued use of the App following any changes constitutes your acceptance of the updated Terms. The Company also reserves the right to suspend or terminate your access to the App at any time, for any reason, including but not limited to a violation of these Terms.

9. No Endorsement of User-Generated Content

The views and opinions expressed by users of the App do not necessarily reflect those of ConnectUs UG. The Company does not endorse or assume responsibility for any user-generated content, and any content posted by users is solely the responsibility of the user who posted it. The Company is not liable for any damages or issues arising from the user-generated content on the App. The Company reserves the right to remove any content that violates its terms of use, policies, or applicable laws.

10. Age Restriction

The App is intended solely for users who are 13 years of age or older. By using the App, you represent and warrant that you are at least 13 years of age. If you are under the age of 13, you are not authorized to use the App. The Company disclaims all liability for any use of the App by individuals under the age of 13.

If you are between 13 and 18 years old you need the consent of your parent(s) and or legal guardian that you are allowed to use the App. The Company disclaims all liability for any use of the App by individuals over the age of 13 but under the age of 18.
